Welcome to FormLeap. These Terms of Service (“Terms”) govern your use of the FormLeap website and services operated by Tristan Peralta (“we,” “us,” or “our”).
By accessing or using FormLeap, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.
1. Description of Service
FormLeap is a web-based form builder that allows you to create forms, collect responses, and manage submissions. We offer both free and paid subscription plans with varying features and limits.
2. Eligibility
You must be at least 18 years old to use FormLeap. By using our service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
If you are using FormLeap on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration
To use certain features of FormLeap, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your login credentials
- Not share your account with others
- Notify us immediately if you suspect unauthorized access to your account
You are responsible for all activities that occur under your account.
4. Acceptable Use
You agree NOT to use FormLeap to:
- Violate any applicable laws or regulations
- Collect sensitive personal information (such as government IDs, financial account numbers, or health information) without proper authorization and security measures
- Send spam, phishing attempts, or unsolicited communications
- Harass, threaten, or harm others
- Upload malware, viruses, or other malicious code
- Infringe upon intellectual property rights of others
- Impersonate others or misrepresent your identity
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to our systems
- Use automated scripts, bots, or scrapers without permission
- Collect personal information from form respondents and sell it to third parties
- Create forms containing illegal, offensive, or pornographic content
We reserve the right to suspend or terminate accounts that violate these terms.
5. User Content
You retain ownership of all content you create using FormLeap, including forms, responses, and uploaded files (“User Content”).
By using our service, you grant us a limited, non-exclusive license to store, display, and process your User Content solely for the purpose of providing our services to you.
You are solely responsible for:
- The accuracy and legality of your User Content
- Obtaining necessary permissions for any third-party content you use
- Backing up your User Content
- Complying with data protection laws when collecting personal information from respondents
6. Form Respondents
When you collect information from others through your forms, you enter into a direct relationship with those respondents. You are responsible for:
- Informing respondents about how their data will be used
- Obtaining necessary consents for data collection
- Complying with applicable privacy and data protection laws
- Providing respondents with a link to our Privacy Policy
7. Intellectual Property
FormLeap and its original content, features, and functionality are owned by Tristan Peralta and are protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our service without our written permission.
8. Payment Terms
8.1 Subscription Plans
Paid subscriptions are billed on a recurring basis (monthly or annually) as specified at the time of purchase. Fees are non-refundable except as required by law.
8.2 Automatic Renewal
Subscriptions automatically renew unless you cancel before the end of the current billing period. You can cancel your subscription through your account settings.
8.3 Price Changes
We may change our prices with at least 30 days’ notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
9. Service Availability
We strive to provide reliable service, but we do not guarantee that FormLeap will be available 100% of the time. We may:
- Perform scheduled maintenance with reasonable notice
- Experience unplanned outages due to technical issues
- Modify, suspend, or discontinue features at any time
10. Disclaimer of Warranties
FORMLEAP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The service will be uninterrupted or error-free
- Defects will be corrected
- The service is free of viruses or harmful components
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRISTAN PERALTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability for any claims arising from your use of FormLeap shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or PHP 5,000, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tristan Peralta from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of FormLeap
- Your violation of these Terms
- Your violation of any rights of a third party
- Your User Content
13. Termination
13.1 By You
You may cancel your account at any time through your account settings. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You may delete your account and all associated data
13.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay applicable fees
- Engage in conduct that harms other users or our service
We will provide reasonable notice before termination, except in cases of serious violations.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the service. Your continued use of FormLeap after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the Philippines.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tristan Peralta regarding your use of FormLeap.
